Ahead of the U.S. Supreme Court's decision to deny TikTok an injunction against the Protecting Americans’ Data From Foreign Adversaries Act of 2024, Senator Mitch McConnell submitted an amicus brief supporting the law. The Kentucky Republican argued that TikTok's appeal lacked merit and urged the court to uphold the ban-or-divestment requirement.
McConnell emphasized that the Act aligns with First Amendment principles, stating, “The right to free speech enshrined in the First Amendment does not apply to a corporate agent of the Chinese Communist Party.” He further noted that allowing TikTok to facilitate censorship on behalf of China contradicts free speech values.
Regarding TikTok's legal strategy, McConnell accused the company of attempting to delay proceedings until a new presidential administration takes office. He remarked, “Delay is the point,” suggesting TikTok hopes for more favorable treatment from future leadership.
He concluded by underscoring the legislative process behind the Act, describing it as a response to national security concerns. McConnell stated, “Successive congresses and presidential administrations realized the danger TikTok poses to American national security.”
